BAI'S PRIVACY POLICY
(as of March 1, 2007)
1. BAI collects and uses information about Client that BAI reasonably believes will help BAI administer BAI's
business or provide products, services or other opportunities to Client. BAI generally uses the information
about Client to perform the Services, to help BAI personalize and improve the experience Client has with BAI,
to respond to Client's inquiries, to process orders, to contact Client regarding account status or customer
service, to let Client know about products or services which may be of interest to Client, or to allow Client
to access specific account information. The types of information about Client that BAI collects and uses
include the following:
(a) Operating Data. When Client registers with BAI,
BAI collects profile information from Client. BAI requires that Client provide information about Client and
its operations, such as the names of personnel, contact data, and other information reasonably necessary for
BAI to deliver the Services. In order to deliver the Services thereafter, BAI collects data respecting
Client's operations.
(b) Services Rendered.
BAI keeps records of the Services that BAI provides to Client.
(c) BAI Website Use.
When Client logs on to Client's Portal Page, it is not anonymous
to BAI. BAI may measure the number of visits to Client's Portal Page, the average time spent in Client's Portal
Page, pages viewed in Client's Portal Page, etc. (collectively, "Personally Identifiable Information")
2. No Cookies.
BAI does not set or access cookies on Client's computer.
3. Restrictions on Disclosing Information.
BAI is not in the business of selling Client's Personally Identifiable Information to others. BAI does not
reveal Client's Personally Identifiable Information to unaffiliated third parties, unless: (1) Client requests
or authorizes it; (2) the information is provided to help complete a transaction for Client; (3) the
information is provided to comply with law, applicable regulations, court orders or subpoenas, to enforce BAI's
agreements, or to protect BAI's rights, property or safety or the rights, property or safety of BAI's users or
others (e.g., to a consumer reporting agency for fraud protection etc.), in which event, BAI shall, to the
extent practicable, provide prompt notice to Client before the information about Client is provided in order
to allow Client to obtain a protective order with respect to such disclosure; (4) substantially all of BAI's
stock or assets is acquired by or merged with another company, in which event, BAI shall promptly notify Client
before information about Client is transferred and becomes subject to a different privacy policy; or (5) the
information is provided to BAI's agents, outside vendors or service providers to perform functions on BAI's
behalf (e.g., analyzing data, providing marketing assistance, providing customer service, etc.), in which event,
BAI shall require such agents, outside vendors or service providers to protect such information to at least the
same degree as BAI is required to protect such information under this Agreement. BAI may share with third
parties experiential information or other data about the use of BAI's services and/or BAI's Website, which
does not personally identify specific clients or users, but which may be based in whole or in part on
Personally Identifiable Information of Client. BAI may share with other clients of BAI experiential
information or other data about Client's aviation operations, which does not personally identify specific
clients or users, but which may be based in whole or in part on Personally Identifiable Information of Client.
Although BAI may send marketing offers on behalf of other businesses and BAI to Client from time to time, BAI
does not give those unaffiliated businesses Client's Personally Identifiable Information except as described
in this Privacy Policy.
4. Security Procedures.
BAI maintains commercially reasonable physical, electronic, and procedural safeguards to protect Client's
Personally Identifiable Information. However, neither data transmission over the Internet or information
storage technology can be guaranteed to be 100% secure. As a result, BAI cannot ensure or warrant the security
of any information Client transmits to BAI online, and Client does so at Client's own risk. BAI also cannot
accept liability for disclosure of any Personally Identifiable Information due to errors in transmission or
unauthorized acts of third parties.
5. Inapplicability of Privacy Policy to Others.
This Privacy Policy only addresses BAI's use and disclosure of Client's Personally Identifiable Information.
This policy does not apply to the practices of third parties.
